For Eatherly, charged with attempted murder where nobody died and who claims self-defense, Nash requested complete detention. The judge declined no bond but set bail at a level that functions as detention for an indigent defendant.
TCA 40-11-118 requires bail to be set as low as necessary to assure appearance. The Tennessee Constitution, Article I Section 16, prohibits excessive bail. Nash's own website says he ensures the criminal justice system is fair to all involved and follows the law as written.
