South Africa is currently at a crossroads regarding the boundary between the State and our private associations.

The CRL Rights Commission — an independent "Chapter 9" institution established by the South African Constitution to protect and promote the rights of the various cultural, religious, and linguistic groups that make up South Africa — is conducting a national consultation on a proposed "Self-Regulatory Framework".

While the official narrative focuses on voluntary cooperation and unity, the underlying technical details suggest a significant shift toward State-controlled regulation of religion.

The draft framework proposes the creation of a statutory council—established by an Act of Parliament—with the power to license, deregister, and oversee religious practice. This effectively moves a fundamental right from being a protected freedom to a state-approved privilege.

Why this matters to you (the "Wildcard")

This campaign is not limited to those of faith. It serves as a test of South Africa’s constitutional democracy:

A Universal Precedent: If the State establishes a statutory council to oversee a fundamental right like religion, it sets a legal blueprint to do the same for any other civil society sector .

The "Ethics" Shift: The framework seeks to regulate "unethical conduct," not just illegal acts. As ethics are often subjective and rooted in belief, this allows for unprecedented State intrusion into private conscience.

South Africa’s municipal financial health has worsened, with UIFWE rising from R264.10 billion to R268.13 billion between 2023/24 and 2024/25. Systemic failures, weak controls, and poor enforcement of procurement and disciplinary processes are key issues. While 170 municipalities saved R5.06 billion through cost containment, overspending on overtime and weak internal systems remain major concerns. Despite some progress in leadership and policy updates, non-compliance and high turnover in key roles continue to undermine governance and accountability.

🟢 BIG CHANGES COMING FOR PENSION FUNDS IN SOUTH AFRICA

South Africa’s Cabinet has approved the Conduct of Financial Institutions (COFI) Bill for submission to Parliament.

The bill would mean one of the biggest regulatory shake-ups in decades for South Africa’s retirement fund industry.

This is according to employment law experts Imraan Mahomed and Thato Makoaba from law firm Cliffe Dekker Hofmeyr (CDH).

🟢 MOTORISTS COULD BE FORCED TO PAY MORE TO DRIVE ON SOUTH AFRICAN ROADS

South African motorists could face paying more to use the country’s roads in the future, with Transport Minister Barbara Creecy warning that widespread tolling may become necessary to maintain them.

Creecy raised the possibility during the Department of Transport’s tabling of its R102 billion budget vote, where she outlined the growing financial pressures facing the country’s road infrastructure.

The minister said the South African National Roads Agency SOC Limited (SANRAL) is expected to receive nearly R31 billion this year to maintain, rehabilitate, upgrade and expand South Africa’s road network.

🟢 NEW RULES PROPOSED FOR SATELLITE INTERNET IN SOUTH AFRICA

The Independent Communications Authority of South Africa (ICASA) has proposed new regulations for earth stations in motion (ESIM) and the registration of foreign satellite operators.

Draft amendments to the Radio Frequency Spectrum Amendment Regulations, 2006, published in the Government Gazette on 15 May 2026, impose fines of up to R5 million for operators who fail to comply.

Interested stakeholders have until 29 June 2026 to provide input on the proposed regulatory amendments for ESIMs and foreign satellite operators.

The NHI is a system that risks infecting – like a virus – the entire healthcare system to the public inefficiencies, corruption, waste and mismanagement extremely prevalent in the public healthcare system.

Instead of bringing public healthcare facilities up to the standard of South Africans deserve, the NHI risks exposing the system to the failures widespread in the public sector: chronic under-resourcing, overburdened facilities, increased vacancy rates among healthcare professionals, corruption and maladministration.

Are South Africans expected to believe that NHI is the only solution to achieve universal healthcare? Please. I previously wrote that competition is the backbone of economic freedom – South Africans have a wide range of retailers to choose where they buy their clothes, their food, appliances, cars, furniture and streaming services.

🟢 ONE YEAR WITHOUT LOAD-SHEDDING THANKS TO SOUTH AFRICANS WITH SOLAR PANELS

South Africa has not experienced load-shedding for a year, primarily due to a substantial reduction in electricity demand driven by the proliferation of private power generation.

Load-shedding tracking app EskomSePush (ESP) announced the milestone in a notification sent to users on Friday, 15 May 2026. The last round of load-shedding ended at 22:00 on the same date a year ago.

The last time South Africa did not have load-shedding for at least a year was between 2016 and 2018.

The Portfolio Committee on Public Service and Administration (PCPSA) has raised concerns around the number of suspended public officials who still receive a full salary.

A recent report by the Sunday Times revealed that 674 officials at both the national and provincial levels were currently suspended.

These suspensions reportedly cost the country around R800 million a year, with PCPSA chairperson Jan de Villiers describing this as “deeply concerning”.

Trade union Solidarity’s Research Institute claimed that Broad-Based Black Economic Empowerment (B-BBEE) policies have encouraged “elite capture” in South Africa.

In other words, these policies have benefited those with political access, legal sophistication, or existing capital, at the expense of ordinary unemployed South Africans.

By benefiting only the well-connected elite, B-BBEE policies have also led firms to delay investment, refrain from hiring, or exit the market entirely as compliance becomes too costly.

🟢 MAY FUEL PRICE ANNOUNCED: HERE'S WHAT YOU"LL PAY FOR OETROL AND DIESEL FROM WEDNESDAY

South Africans will be hit with another round of fuel price increases from Wednesday, May 6, with petrol and diesel set to rise at an even higher rate than initially anticipated.

The Department of Mineral and Petroleum Resources (DMPR) confirmed on Monday that the price of both grades of petrol will increase by R3.27 per litre, while diesel will go up by R6.19.

Although month-end data from the Central Energy Fund had initially pointed to increases of R2.04 for 95 Unleaded and R4.96 per litre for 50ppm diesel, the implementation of the Slate Levy has added a further R122.70 to the price of both fuels, the department confirmed. The Slate Levy essentially compensates fuel companies for price fluctuations that took place in the preceding month. The cumulative slate reflected a negative balance of R14.17 billion at the end of March 2026, the department added.

🟢 WARNING FOR CERTAIN MARRIAGES IN SOUTH AFRICA WITH NO PRENUP

In a 2026 decision, the Constitutional Court ruled that both customary and civil marriages receive equal legal recognition, making it difficult for individuals in customary marriages to enter into antenuptial agreements after marriage.

The law says that spouses in customary marriages cannot enter into an antenuptial agreement after attempting to convert to a civil marriage in South Africa; they would need an antenuptial agreement from the start of the arrangement.

A civil marriage is a legally recognised union between one man and one woman, excluding all others. It is governed by the Marriage Act in South Africa.

Deputy Chairperson of the South African Geographical Names Council, Johnny Mohlala, says the renaming of cities and towns is too slow, and new laws should accelerate the process.

The South African Revenue Service (SARS) has gazetted the first details for the 2026 tax season, including the final submission dates and who does and does not have to file a return.

SARS has not yet published the official window for tax season 2026, but has confirmed that it will run through to 23 October 2026 for individual taxpayers and to 22 January 2027 for provisional taxpayers.

The tax year under assessment for 2026 is the financial year for companies that end during the 2026 calendar year and the 12-month period ending 28 February 2026 for individuals.

I’m reaching out as something significant is moving through the halls of government that demands your attention. While the headlines often focus on the latest political "antics," a 40-page document was recently released that could fundamentally shift the legal relationship between you and your private property.

The National Treasury has published the Draft Capital Flow Management Regulations, 2026. While it’s being discussed in many circles as a "crypto crackdown," the fine print reveals that this is about everything you own.

If you own a home, hold physical gold, or have ever created a piece of intellectual property, these regulations affect you. The draft defines "capital" as "anything with a monetary value", including intellectual property and anything that can be converted to money.

Here are the red flags we’ve identified:

Your Home: The Treasury can "attach" your land or home based on mere "reasonable grounds to suspect" a technical contravention. This attachment can be noted directly against your title deed at the Deeds Registry, effectively freezing your ability to sell or bond your own property.

Your Gold: If you own gold (beyond jewellery or coins) above a "determined threshold," you are legally required to offer it for sale to the National Treasury within 30
days. The State fixes the price.

Your Privacy: In a move that feels like a significant erosion of personal freedom, Regulation 25(5) requires you to hand over all passwords, PINs, or private codes to the State if they decide to forfeit your assets.

The National Treasury and the Reserve Bank argue that these changes are vital for South Africa's survival in the global financial system. They state that:
FATF Compliance is Essential: After our recent exit from the "grey list," the State is under pressure to prove it can track and halt money laundering and terrorism financing.

Bitcoiners are outraged at proposed new exchange control regulations in South Africa that will criminalise anyone sending or receiving bitcoin (BTC) across border without permission.

“These regulations put us alongside North Korea in terms of financial freedom,” says one, who asked not to be named.

Trade union Solidarity has confirmed that it plans to go ahead with its court case challenging the constitutionality of South Africa’s Public Procurement Act, despite the recent issuance of new draft regulations under this legislation.

This Act was assented to by President Cyril Ramaphosa in 2024, with Solidarity launching its court case shortly after.

At the time, the President said this legislation is another important step in ensuring that “public funds are put to use where intended”.

🟢 CONSTITUTIONAL COURT TO HEAR CHALLENGE AGAINST NHI NEXT MONTH

The Constitutional Court is gearing up to hear the legal challenge regarding the National Health Insurance Act and whether Parliament acted in accordance with the Constitution when it passed the NHI Act.

The legal challenge will be heard from May 5 to May 7 during which the Board of Healthcare Funders and the Western Cape Government (WCG) will argue they were not properly consulted during the Bill’s development and the Act’s assent.

The litigation that has been initiated against the President and the Minister of Health has meanwhile necessitated that President Cyril Ramaphosa, following consultations with Minister Aaron Motsoaledi, agreed to delay the proclamation of any sections of the National Health Insurance (NHI) Act until the Constitutional Court has handed down its judgments in the two challenges.
