EDITORIAL: On a fiscal cliff of their own making

Once again, Colorado legislators are scrambling to address a whopping $1.5 billion deficit of their own making.

There’s a simple reason for that. Just last year, when Gov. Jared Polis called a special session to address what was then an $800 million shortfall on a $44 billion budget, lawmakers failed to do the heavy lifting to forestall a longer-term fiscal crisis.

Colorado’s ruling Democrats got themselves into a jam by creating dozens of programs, offices and departments over the past eight years — hitting up taxpayers for hundreds of millions of dollars.

Progressives flex power at Democratic assembly

Chanting "when we fight, we win," Colorado Democrats on Saturday overwhelmingly endorsed a challenger to an incumbent U. S. senator, a former two-term governor.

Why it matters: The progressive faction within the party flexed its influence at the state assembly in Pueblo and delivered a loud and clear message to their leaders: No seat is safe, especially not the status quo.

Driving the news: The nomination of state Sen. Julie Gonzales (D-Denver) to challenge U. S. Sen. John Hickenlooper (D-Denver) in June's primary election is possibly the starkest example, but not the only one.

Gutting taxpayer protections won’t fix Colorado K-12 education

You’ll never guess what teachers’ unions think we need to improve school performance. Yep: More taxes. That’s never not the answer from that crowd. The answer couldn’t possibly be to spend existing resources more wisely, trim bloated school bureaucracies, or embrace teaching methodologies that actually work.
Bogus claims about school funding

During a March 5 event introducing Senate Bill 26-135, to ask voters to direct TABOR refunds partly to schools, State Sen. Jeff Bridges claimed that Colorado “schools [are] funded near the bottom of the country.” He continued, “Right now Colorado ranks near the bottom nationally in what we invest in K12 public education.”

Rae Solomon wrote March 13 for Colorado Public Radio, “Democratic backers of the bill say Colorado schools have been chronically underfunded by about $1 billion dollars a year for more than a decade, resulting in a tattered education system where teachers are underpaid and burnt out, classrooms are overcrowded, and students can’t get services they need. U. S. Census data consistently puts Colorado’s per-student funding in the bottom 20 states.”

Colorado lawmakers pass bill to ban 3D printing of guns after veto threat forces amendments

Colorado lawmakers were poised Monday to pass legislation prohibiting people from using 3D printers to make firearms and gun components — but only after stripping out a key provision in the face of a veto threat from Gov. Jared Polis.

As it stands, House Bill 1144 would expand on the state’s existing ban on unserialized “ghost guns” by prohibiting anyone from using a 3D printer to manufacture guns or components like large-capacity magazines and rapid-fire trigger activators. The Democratic measure passed the Senate on a party-line 23-12 vote Monday morning.

The bill now needs a procedural vote in the House before it moves to Polis for signature into law.

Colorado Democrats flesh out statewide primary ballot

PUEBLO–Colorado Democrats gathered for their party assembly in Pueblo over the weekend, with nearly 1,400 delegates casting votes to send candidates on to the June 30 statewide primary election.

Candidates needed to garner at least 30 percent of the vote to advance, with the top-vote getter appearing first on the ballot

Notably absent were big-name Democrats John Hickenlooper, running for re-election to the U. S. Senate, and Michael Bennet, a sitting U. S. senator running for governor. As previously reported by Complete Colorado, the two men successfully petitioned on the primary ballot, allowing them to forgo the caucus and assembly process.

Colorado Progressives Shift Budget Blame to TABOR and Taxpayers

Like thousands of enlightened technocrats who came before them, Colorado’s progressive legislators believe that they are uniquely endowed to once and for all fix structural flaws in the state’s budget and finally bring “fairness” and “equality” to Colorado.

If they could only eliminate the Taxpayer’s Bill of Rights (TABOR, heavily tax the rich, and preserve their preferred special interest tax breaks, then Colorado would have heaven on Earth.

Democrats are proposing a dangerous income tax increase under the guise of funding education (Opinion)

Colorado families are being asked to believe a familiar lie; the only way to fund education is to let politicians take and keep more of your money — forever.

Senate Bill 135 is disingenuous and is not a serious education plan. It is a backdoor attack on TABOR dressed up in the language of helping kids.

Without raising taxes, I have spent six years fighting to increase education funding by more than $1.3 billion. Governing the right way by setting priorities, making hard choices, and funding schools without breaking faith with taxpayers.

Now compare my success with the Democrats’ plan in SB 135. SB 135 asks voters to get rid of their TABOR refund forever in order to grow state spending by up to $5 billion annually. While possibly giving a paltry $200 million a year for 10 years to education.

Colorado House passes bill allowing Front Range homeowners to split lots to make room for housing

The Colorado House passed legislation Tuesday that would allow homeowners across the Front Range to split their lots and sell them with minimal local government input.

House Bill 1308 cleared its first legislative chamber on a 39-26 vote, with most Democrats in support and every Republican, plus a handful of Democrats, opposed. The bill is the latest in a multiyear effort by Democratic lawmakers and Gov. Jared Polis to reform local land-use laws, especially in urban areas, to ease housing development.

HB-1308 builds directly on one of those prior measures, which let homeowners build accessory dwelling units on their properties without local government approval. ADUs include “granny flats,” backyard cottages and garage apartments. If passed and signed into law, this year’s bill would allow a homeowner who has built an ADU to then split the lot and sell the ADU, while keeping their own home.

Business-backed bill to review regulations clears committee on unanimous vote

Colorado legislators across the ideological spectrum agreed Tuesday that the state needs to more thoroughly review the efficacy of its more than 200,000 regulations — and passed a bill unanimously out if its first committee that would require officials to do just that.

Senate Bill 137 — sponsored by Democratic Senate President James Coleman, Republican Senate Minority Leader Cleave Simpson and their House leadership counterparts — comes at a pivotal moment when job growth has slowed in Colorado and the cost of living is up. Its aim, as a litany of supporters told the Senate Finance Committee, is not to repeal vast swaths of rules but to make state leaders examine which are working as intended and which may be duplicative, outdated or so costly as to be detrimental to Colorado.

It would do so by requiring state agencies to dig into their regulations at least every five years and examine if they are redundant or obsolete, whether there are ways to improve their effectiveness and if funding levels to support the rules are appropriate. They must present their findings to legislative committees during the SMART Act hearings that begin every session, and legislators could request audits and sunset reviews of the regulations if they feel they are warranted.

Colorado’s local elected officials have the power to provide badly needed property tax relief (Editorial)

Coloradans badly need property tax relief. And it must come from our local elected officials who have the power and means to reduce our taxes.

We don’t just need the rate of increase to ease, or even to stop; we need a full reversal, a reduction in single-family home and multi-family home property taxes.

For more than a decade, property taxes have increased unabated, driven by tax increases, new districts and mostly by the rising value of homes. Now homeowners are feeling the pinch – property tax increases that have outstripped even America’s brutal inflation rate this past decade.

Property taxes in Colorado primarily fund schools, counties, cities, water, fire protection, and debt from developer spending.

How much a property owner pays is based on a complex formula that considers three things: the local tax rates (known as mill levies), the state-wide assessment rate and the assessed value of the property.

Man convicted of child sexual assault in Colorado arrested 20 minutes away from US-Mexico border

A man convicted of sexually assaulting a child in Colorado was 20 minutes away from the U. S.-Mexico border when he was arrested after a “vigilant citizen” saw him and alerted authorities.

Law enforcement officials on Monday revealed new details about the arrest of Jorge Alberto Campos, 42, who fled Colorado before a jury convicted him of five counts of sexual assault on a child.

Law enforcement officials are now raising questions about the amount set for his bond, as well as why authorities were not immediately notified that he had tampered with his GPS monitoring system.

Campos failed to appear in court on Friday. It turned out he had cut off his GPS ankle monitor the previous night, prosecutors said during a news conference. He was arrested Sunday some 600 miles away in Chaparral, New Mexico, just 20 minutes from the U. S.-Mexico border.

Authorities said Campos, who is a Mexican citizen living in the county illegally, carried his passport at the time of his arrest. The Otero County Sheriff’s Office took Campos into custody after a citizen recognized Campos from a Denver media outlet and called authorities.

Closure of Denver cannabis growhouse will bring 132 layoffs

A major cannabis company will close its facility in north Denver and lay off 132 employees in May.

PharmaCann Inc., which is the parent company of LivWell, detailed the job losses in a March 20 notice to the state of Colorado. The 132 layoffs include employees who work in cultivation, data, farming and production, according to the notice.

“The entire Facility will close on May 20, 2026. The action is expected to be permanent,” chief manufacturing officer Nathan Fete wrote in the notification. The production and distribution facility is located at 5141 N. National Western Drive.

Denver delays Axon ALPR camera contract

The City and County of Denver still hasn’t officially broken up with automated license plate reading camera vendor Flock Group, as members of the City Council agreed Monday to delay approving a new contract with Arizona-based ALPR maker Axon.

Denver Councilman Kevin Flynn asked the council to postpone the contact for one week.

Several on the council called into question risks of approving the contract before the city has an overarching ordinance on surveillance.

Residents and privacy advocates filled the Parr-Widener Community Room for a special one-hour courtesy public hearing on the matter, with 55 individuals signed up for comment.

While Axon’s proposed $150,000 contract for a 50-camera system is about half of Denver’s current 111-camera system with Flock, opponents argue the technology poses the same risks because there are “no proper guardrails” in place to protect their privacy and personally identifiable information, the statement added.

Privacy and civil rights advocates have stated that the matter has come down to the wire as Flock’s contract with the city ends March 31.

The new Axon contract was not shared with Task Force members until March 19, and shared with the City Council on March 13, just five days before the committee vote, according to a statement from the American Civil Liberties Union.

Talk show legend Montel Williams to premier new series in Denver

DENVER — Daytime Emmy Award-winning TV Host Montel Williams is coming to Denver to premiere a new talk show series called “The Only Way Out is Through."

Williams was the host of the nationally syndicated Montel Williams show for 17 years, covering topics like family and relationship issues.

The first episode of his new series will focus on youth violence.

Williams said he chose Denver due to its proximity to the Columbine High School tragedy.

Colorado’s growing share of unaffiliated voters is making it harder for candidates to get on the ballot

The dwindling number of Democratic and Republican voters in Colorado is making it increasingly harder for candidates from the two major parties to gather petition signatures to get on the primary ballot.

That’s because Democratic candidates must collect signatures from voters registered as Democrats to make the ballot, and Republican candidates need signatures from voters registered as Republicans.

Petition signatures from unaffiliated voters — who can cast ballots in the major parties’ primaries and, as of March 1, made up 50% of the state’s 4 million active, registered voters — can’t be used by major party candidates to get on the primary ballot.

Colorado Dems Advance Anti-Gun Bills Including Barrel, 3D Printing Restrictions

Last Friday, the Colorado House gave preliminary approval to bills that expand Colorado’s so-called "Red Flag" gun seizure law, bring a crackdown on privately made (or enhanced) firearms, and force the state's firearm dealers to maintain a de facto gun registry.

Among the proposals, SB26-004 would expand the list of people eligible to petition for an Extreme Risk Protection Order. Added to the list of first responders and family members would be those working at health care facilities, behavioral health treatment facilities, K-12 schools, and higher education institutions.

Next is SB26-043, which would require firearm barrel sales or transfers to be done through a federally licensed firearm dealer. Under the bill, FFLs would also be required to keep a record of these transactions for at least five years. The unanswered question is whether barrels would need to be serialized or marked by the dealer before transfer to ensure tracking. This would make simple tasks such as ordering a replacement shotgun barrel or a complete AR upper an FFL-required process in Colorado, with the inevitable extra fees and red tape along for the ride.

HB26-1126 would mandate that all firearm dealers in the state – even individuals – hold a $400 state permit to sell firearms and firearm components. It requires "large-capacity magazines" to be kept behind a counter in a locked case or in a locked room that is not accessible to the public. The bill also expands record-keeping requirements by requiring firearm transactions to be recorded and requiring that these records be maintained electronically and made available to law enforcement. Shops found out of compliance could face a business-crippling fine of up to $100,000.

The bills face a final House vote on Monday.

RTD to consider service reductions, job cuts in face of $215 million deficit

Financial realities hit hard at the Regional Transportation District’s headquarters Tuesday afternoon as managers told elected directors they must correct a $215 million deficit by 2027 in an agency budget that has been out of balance for years.

That means bus and train services could be reduced or potentially eliminated for metro Denver residents across RTD’s 2,345-square-mile service area that spans eight counties. The extent of service cuts wasn’t immediately clear.

RTD’s directors bristled with frustration, demanding an explanation — and initially refused to enter into a closed executive session, where they received legal advice about possible job cuts.

RTD general manager and chief executive Debra Johnson declined to comment on possible service reductions.

“That would be premature,” she said.

The prospect of transit reductions hit at a difficult time for RTD as ridership lags and state lawmakers, who created the agency in 1969 to develop, run and maintain a mass transportation system, draft legislation to overhaul the agency’s governance by replacing some of the 15 elected directors with appointees.

Colorado lawmakers kill bill requiring cops to ID themselves, advance other immigration measure

Colorado lawmakers have killed a measure that would’ve prohibited local police from hiding their identities while also giving them the explicit authority to step in when federal agents use excessive force.

In another vote, the House’s Judiciary Committee narrowly advanced a second immigration-related bill during the meeting, which stretched into Tuesday night. That bill would broadly seek more transparency and oversight of some federal activities in the state.

The defeat of House Bill 1275 came after several hours of testimony on both measures. HB-1275 was backed by progressive and immigrant-rights organizations, but it was opposed by law enforcement groups.

It died on a 5-6 vote, with two Democrats joining the committee’s four Republicans in voting no.

Cop’s skull smashed in creek fight as repeat offender suspect walks on $100 bond

A Colorado police officer suffered a serious head injury during a violent struggle with a suspected drug dealer, but the suspect was released on just $100 bond despite prosecutors pushing for a much higher amount.

The incident happened Tuesday evening in downtown Boulder, where officers were responding to ongoing complaints about open drug use and overdoses in a public park.

According to police, officers were speaking with a woman seen smoking suspected methamphetamine when she pointed them to a man nearby who she said had sold her the drugs. When officers approached the suspect, later identified as Kai Brown, he attempted to flee.

An officer gave chase, and during the struggle, both the officer and Brown fell into Boulder Creek. Police said the suspect landed on top of the officer, who struck his head on a rock.

ROSEN: Package of ‘decoupling’ bills end-run Colorado taxpayer protections

The governor and progressive Democrats that dominate the state legislature and every statewide office in Colorado have been masterful ― if not ethical and honest ― in devising devious schemes to circumvent the TABOR amendment in the Colorado Constitution. That’s the Taxpayer’s Bill of Rights, passed by a 1992 voter-initiated ballot measure that bypassed the legislature. It limited government spending and barred the legislature from increasing taxes or imposing new ones without the consent of the voters. Democrats have always despised TABOR.

Their favorite ploys have included misrepresenting taxes as “fees” and funding spending programs through tax credits. Because those credits reduce government revenues, they’re the equivalent of government spending but isn’t accounted for as such.

Now, the Democrats’ legislative super majority has presented a package of four bills championed by its Communist Coalition, the likes of Emily Sirota, Lorena Garcia, Mike Weissman, Julie Gonzales, and others. The bills “decouple” Colorado’s tax code from the federal government’s to “rebalance” Colorado’s tax code. Translating that into forthright language, “decouple” means denying tax deductions to businesses that the federal government allows. “Rebalance” means sharply inflating taxes and government spending.

Two hotly contested immigrant-rights bills prompt a marathon debate at the Colorado Capitol

State lawmakers debated two bills Tuesday that allow Coloradans to sue federal agents and further limit state and local police cooperation with federal agents.

House Bill 26-1276 expands protections for undocumented immigrants and creates new mandates that impact not only law enforcement but RTD and Denver International Airport.

Under the measure, they are barred from helping or enabling Immigration and Customs Enforcement agents to transport detainees.

U. S. Rep. Diana DeGette walloped by democratic socialist at county assembly. Does this spell trouble for incumbents?

A democratic socialist candidate crushed U. S. Rep. Diana DeGette in a preliminary intraparty vote at last weekend’s Denver County assembly — with Melat Kiros outorganizing a veteran lawmaker who’s been in office longer than Kiros has been alive.

The shock drubbing, delivered ahead of a formal assembly vote next week, was among signs that Democrats participating in the party’s caucuses and assemblies are dissatisfied with incumbent officials. Some other incumbents, including U. S. Sen. John Hickenlooper in his reelection race and Sen. Michael Bennet in the governor’s race, have been leaning on the petition route to the ballot rather than facing primary opponents at the March 28 state assembly.

At the Denver Democrats’ county assembly on Saturday, Kiros — a 28-year-old doctoral student and former lawyer — won 646 votes, or 63%, compared to DeGette’s 336 votes, or 32%. The result was the first time DeGette, 68, has lost a county assembly vote since she entered Congress in 1997, Kiros’ campaign said.

If that level of support holds at the party’s 1st Congressional District assembly on March 27, Kiros will cruise to a place on the June 30 primary ballot. DeGette, meanwhile, cannot afford to lose any more ground: If fewer than 30% of delegates support her at that virtual assembly, she won’t make the ballot at all. Time is rapidly running out to switch tactics and get on the ballot by submitting voter signatures, with petitions due to the state on Wednesday.

Lawmakers can stop corporate welfare by voting against a $60 million tax break for data centers (Opinion)

When governments give favored corporations bailouts, grants, and tax breaks, they direct taxpayers’ money away from the public good to private interests. Politicians often say they oppose corporate welfare, but they need to prove it, not in words, but in actions. Luckily for them, Colorado legislators have an opportunity to do so this session.

They should vote against Colorado House Bill 1030, which would encourage technology companies to build their data centers in the state by offering them a 100% state sales and use tax exemption on qualified purchases for at least 20 years. The tax loophole would decrease the state’s general fund revenue by $29 million in the 2027-28 fiscal year and $59 million in the next.

While the giveaway might persuade tech companies to say yes to Colorado, it’s one more reason residents should say no. Data centers that house computers for artificial intelligence and data storage consume enormous amounts of energy and water and create comparatively few jobs. Moreover, favoring big tech over other enterprises is inherently unfair to all those businesses that pay their state sales and use taxes.

Bill targeting taxpayer refunds clears Colorado Senate committee

DENVER–Couched as a state education funding effort, legislation to siphon off overcollected revenue that would otherwise be refunded to Colorado taxpayers passed out of a Democrat-controlled Senate committee on Thursday.

Senate Bill 26-135, “State Public K-12 Education Funding,” refers a question to Colorado’s November ballot to increase K-12 education funding by 2% annually for the next ten years. According to the bill, the money is intended to go towards teacher pay increases and retention, lowering class sizes, and technical career programs.

Along with raising education appropriations, the bill allows the state to keep and spend excess revenue collected above the limitations in the Colorado Taxpayer’s Bill of Rights (TABOR).

TABOR, among other things, limits the growth of a portion of the state budget to a formula of population growth plus inflation. The state is required to refund revenue collected over the limit back to taxpayers. While SB-135 asks voters to give up their refunds for the foreseeable future, recent polling shows TABOR remains quite popular among active voters, with a 61 percent approval overall.

Colorado ethics panels tells legislator to attend sexual harassment training

Colorado’s House ethics panel admonished a Republican legislator over allegations he used a master key to access areas of the Capitol that he was not permitted to enter and that he had made sexually harassing comments to several female lawmakers.

In addition to sending a letter to Rep. Ron Weinberg, R-Loveland, the House Ethics Committee committee ordered the legislator to attend sexual harassment prevention training.

The allegations against Weinberg were contained in a complaint filed by Rep. Brandi Bradley, R-Roxborough Park, last July. She also filed a campaign finance complaint, which included some of the same allegations.

The ethics committee decided to leave the campaign finance complaint to the Secretary of State’s Office, where a hearing is pending.

Tech glitches disrupt Colorado Democrats as they consider primary candidates

Over the last two weekends, Colorado Democrats held caucus meetings to help decide who will be on the primary ballot in June, but the meetings were beset with technical difficulties that have led to confusion and consternation from some who attended and concerns about whether delegates lost their voice in the process.

In previous years, the process has run on paper ballots and in-person voting. This year was the first time the Party introduced voting by app.

Delegates described using Airtable, a business workflow app that is not designed to run elections, to register their votes. The software struggled to handle the high volume of users throughout the process, and finally crashed toward the end of the day on March 14.
